ORDINANCE No 852

AN ORDINANCE OF THE BOROUGH OF HOPEWELL IN THE COUNTY OF MERCER, STATE OF NEW JERSEY AMENDING “THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF HOPEWELL, 1975,” AS AMENDED BY AMENDING CHAPTER II (ADMINISTRATION), BY ADDING A NEW SECTION 33 ENTITLED “PEDESTRIAN, BICYCLE AND SAFETY ADVISORY COMMITTEE”

            BE IT ORDAINED by the Mayor and Council of the Borough of Hopewell as follows:

Section 1.  Pedestrian, Bicycle and Safety Advisory Committee 

There is hereby established a Pedestrian, Bicycle and Safety Advisory Committee consisting of five regular members. No more than one member may be a resident of a municipality other than Hopewell Borough. In addition to the voting members, there shall also be one non-voting liaison from the Planning Board and one non-voting liaison from the governing body.  Members shall serve with no salary or compensation. The Mayor may, subject to approval by Council by resolution, remove any committee member from office, with or without cause. Meetings of the Committee shall be subject to the New Jersey Open Public Meetings Act, and annually the Committee shall elect a chairperson, vice chairperson and a secretary from its voting members. 

Section 2.  Duties. 

The responsibilities and authority of the Committee shall be as dictated by the Council from time to time, as may be necessary, and shall include providing research and advice to Council on matters relating to policies and facilities which promote and enhance the safety, comfort, and convenience of bicyclists, pedestrians, and automobiles in the Borough, as well as other users of micro-mobility. Specifically, the Committee shall:

  1. Study and collect data, information and opinions on pedestrian, bicycle and safety matters throughout the Borough and the surrounding areas.
  2. Prepare an inventory for each street in the Borough that lists deficiencies and suggests recommended improvements.
  3. Propose initiatives for the promotion of safety in the Borough to the Borough council.
  4. Compile and submit to the Borough Council a comprehensive report of its findings and include suggested priorities for action.
  5. Review and update the findings of the initial or most recent report no later than every ten (10) years.

Section 3. Appropriation from the Borough

The Committee shall receive an annual budgetary appropriation as shall be deemed appropriate by the Borough Council for the purposes of the Committee.

Section 4. No Power to Incur Obligations

The Committee shall not have the power to incur any obligation in the name or forth the account of the Borough.  All expenditures shall be processed through the Borough in accordance with the Local Public Contracts Law (NJSA 4A:11-1 et seq.) and the purchasing polices of the Borough of Hopewell.

Section 5. Ethics

The Committee members shall adhere to statutory responsibilities assigned to local government officials in accordance with the Local Government Ethics Law (NJSA 40A:9-22 et seq.) 

Section 5. This Ordinance shall take effect upon final passage and publication according to law.
